Terms of Service

These Terms govern access to and use of FixNik OS. By creating an account, using the service, or allowing another person to use your workspace, you agree to these Terms.

The service and your account

FixNik OS is software for service businesses that may include customer management, jobs, quotes, invoices, websites, communications, staff tools, and related features. You are responsible for your account, credentials, authorised users, business information, and for ensuring your use complies with applicable law.

Subscriptions, trials and plan changes

FixNik OS offers Starter, Professional, and Business subscriptions. Professional may include a 14-day free trial when offered at checkout. A payment method is required for that trial and the applicable Professional subscription fee is charged automatically after the trial unless the subscription is cancelled before it ends. Starter and Business subscriptions are charged as shown at checkout. Subscription charges, renewals, plan changes, cancellations, and payment methods are processed by Stripe.

You may cancel a subscription at the end of its current billing period through the available billing controls. A scheduled cancellation does not normally provide a refund for the current period. Plan changes, features, and access take effect according to the billing flow shown at the time of change.

Usage limits and availability

Plans include usage limits and feature availability shown in FixNik OS and at checkout. We may restrict new use of a feature when its plan limit is reached; existing customer data is not deleted solely because a limit is reached. Service availability may be affected by maintenance, third-party services, connectivity, or events outside reasonable control.

Acceptable use

You must not use FixNik OS to break the law, infringe rights, send spam or harmful content, interfere with the service, bypass security or plan controls, introduce malware, or access another customer's data. We may suspend or restrict access where reasonably necessary to protect the service, users, or third parties.

Your content, websites and AI-generated material

You retain responsibility for the business, customer, website, and other content you submit or publish using FixNik OS. You grant us the rights needed to host, process, and display that content to provide the service. You must review AI-generated text, images, websites, and SEO suggestions before use and remain responsible for their accuracy, suitability, rights clearance, and legal compliance.

Third-party services

FixNik OS may integrate with third-party providers, including Stripe for subscription payments and Resend for email delivery. Their services are subject to their own terms and availability. We are not responsible for third-party services outside our reasonable control.

Intellectual property

FixNik OS and its software, branding, and service materials are protected by applicable intellectual property laws. These Terms do not transfer ownership of FixNik OS to you. You may use the service during an active subscription in accordance with these Terms.

Termination and limitation

You may stop using the service at any time. We may suspend or terminate access for material breach, non-payment, security risk, or unlawful use. To the extent permitted by law, FixNik OS is provided on an as-available basis and liability is limited to the amount paid by you for the service in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes rights or remedies that cannot be excluded by law.

Governing law and contact

These Terms are governed by the laws of Victoria, Australia. Courts located in Victoria have non-exclusive jurisdiction, subject to any mandatory law that applies to you. For support or questions about these Terms, contact support@fixnikos.com.
